Ludexio Tally Terms of Use

Ludexio Tally is published by Ludexio Games, a trade name of Ludexio LLC, a company registered in the District of Columbia, United States, at 1717 N St, Ste 1, Washington, DC 20036 (“Ludexio Games”).

Downloading or using Ludexio Tally, on any device, means accepting these terms. If they are not acceptable, do not use the app. Questions go to support@ludexiogames.com.

The short version. The app is for people 13 and over. What you create stays yours. Nobody is shown advertising and no data is sold. Anyone in the app can be reported and blocked, and every report is reviewed within 24 hours. Purchases go through Apple, so Apple handles cancellations and refunds. Disputes go to arbitration, and there is a 30 day window to opt out of that.

1. Who may use Ludexio Tally

Ludexio Tally is for people aged 13 and over.

Anyone who is a minor where they live, generally under 18, needs a parent or guardian to read and agree to these terms first, and to supervise their use of the social features.

2. Accounts

Ludexio Tally works without an account. Scoring a game, keeping a library and seeing your own statistics all happen on your device.

An account exists so you can connect with friends, sync between your own devices, and recover your data if you lose access to iCloud. Creating one is your choice and it can be deleted at any time from Settings.

You are responsible for what happens on your account. Keep your device secure, and write to support@ludexiogames.com if you believe someone else is using it.

Ludexio Games may reclaim or change a display name or @handle that is misleading, impersonates somebody, or breaches the next section.

3. What you may put into the app

You choose your display name, your @handle, your profile photo, the names of the people you play with, and the notes you keep about your games. Some of that is visible to friends you connect with.

Objectionable content and abusive behaviour are not tolerated. You agree not to use Ludexio Tally to:

4. Reporting and blocking

Anyone visible in the app can be reported and blocked. Both are available from a friend’s profile, from an incoming friend request, and from the shared game inbox. Blocking removes the connection, cancels any pending request in either direction, and stops anything further reaching you.

Every report is reviewed within 24 hours. Where a report is upheld, the offending content is removed and the person responsible is ejected, which may mean their account is suspended or permanently deleted. No warning is required first, and no explanation is owed to the person removed.

Filing reports in bad faith, or repeatedly, is itself a breach of these terms.

5. Your content

What you create in Ludexio Tally stays yours.

By using the sharing features you give Ludexio Games permission to store your content and show it to the people you have chosen to share it with, for as long as you keep sharing it. That permission exists so the app can work and for no other purpose. Your content is not sold, not licensed to anyone else, and not used to train anything.

Sharing is controlled in Settings and every part of it can be turned off.

6. Paid features

Some features require a paid subscription.

Purchases are processed by Apple through In-App Purchase and are subject to the terms of the App Store account used. Ludexio Games never sees or stores your payment details.

Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends. Cancel in your Apple ID settings, not in the app, since Apple manages the subscription. Refunds are handled by Apple under the App Store refund policy.

What each tier includes, and the price, are shown in the app before you buy. Deleting the app does not cancel a subscription.

7. Advertising

Ludexio Tally does not show advertising, does not sell your data, and does not track you across other apps or services.

8. Game information

Game titles, descriptions, images, ratings and categories come from BoardGameGeek and are used under the BoardGameGeek API licence. That information belongs to BoardGameGeek and its contributors, is not altered, and is not the property of Ludexio Games. Powered by BGG.

9. Ending your use

You can delete your account at any time from Settings. Deleting removes the account, the records held on Ludexio Games’ systems, and the data stored on your device.

A small number of records are kept for safety reasons, such as the fact that a report was filed. Those contain none of your personal content.

Ludexio Games may suspend or end an account that breaches these terms, or where the law requires it. Anyone whose account is ended for a breach may not register again, under their own name or any other.

10. The app is provided as it is

Ludexio Tally is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. Accuracy and availability are taken seriously and neither can be guaranteed.

Scores, statistics and game information may contain errors. Ludexio Tally is a scorekeeper, not a system of record.

11. Limits on liability

To the fullest extent permitted by law, Ludexio Games is not liable for indirect, incidental, special or consequential loss, or for lost data or lost profits, arising from your use of Ludexio Tally.

Where liability cannot be excluded, it is limited to the greater of the amount you paid Ludexio Games in the twelve months before the claim, or fifty US dollars.

Nothing in these terms limits liability that cannot be limited by law, and nothing removes a right you hold under the mandatory consumer law of the country you live in.

12. Indemnity

You agree to cover Ludexio Games’ reasonable losses and legal costs arising from your breach of these terms, from content you posted, or from your misuse of the app. Ludexio Games will tell you promptly about any such claim and will not settle it without talking to you first.

13. Changes to these terms

These terms may be updated. Significant changes will be shown in the app before they take effect. Continuing to use Ludexio Tally after that means the new terms are accepted.

14. Governing law

These terms, and your use of Ludexio Tally, are governed by the laws of the District of Columbia, United States, without regard to its conflict-of-laws rules.

15. Resolving disputes

Start by writing. Most problems are settled fastest by email. Before anything formal, send the details to support@ludexiogames.com and allow 30 days for a reply.

Arbitration. If that does not resolve it, any dispute will be settled by binding individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association, and where applicable its Supplementary Procedures for Consumer Related Disputes. Arbitration happens in the District of Columbia or, at your choice, remotely. Agreeing to arbitration means giving up the right to sue in court and the right to a jury trial.

You can opt out, and you have 30 days. If you do not want to be bound by the arbitration clause, email support@ludexiogames.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these terms. Include the name and @handle on your account. Opting out changes nothing else: your account, your access and the rest of these terms are unaffected, and disputes are then settled in the courts named in section 14.

Small claims are always available. Either you or Ludexio Games may bring a qualifying claim in small-claims court instead of arbitration, and doing so is not a breach of this section.

No class actions. Arbitration is individual. Claims may not be joined or consolidated, brought as a class action, or brought in a representative capacity on behalf of others.

What arbitration does not cover. Disputes about intellectual property, and claims of theft, piracy, invasion of privacy or unauthorised use, may be brought in court.

Where this does not apply. In jurisdictions that do not permit binding arbitration for consumers, including much of the European Union and the United Kingdom, this section does not apply and your local law governs instead.

16. Everything else

If any part of these terms is found unenforceable, the rest stays in force.

Not enforcing a term on one occasion does not waive it. These terms, with the Privacy Policy, are the whole agreement between you and Ludexio Games about Ludexio Tally. You may not transfer them to anyone else; Ludexio Games may transfer them as part of a sale or reorganisation of the business.

Communications sent to you electronically, in the app or by email, satisfy any requirement that they be in writing.
